The increasing significance of open source in software development for companies is widely acknowledged. However, this recognition comes with a parallel need for a precise understanding of open source compliance and associated risks and appropriate management. In the context of leveraging open source, there are expectations for intellectual property (IP) experts to contribute as both technical and legal specialists, guiding companies from those aspects.

In CHIZAI (IP) seminar series, we are offering a two-part session on open source. Following the first session focused on technology (held on December 1), this second seminar will shift its focus to IP.

We are pleased to welcome our distinguished speakers Keith Bergelt from Open Invention Network, Masato Endo from Toyota, Shane Coughlan from OpenChain, and Yoshiro Matsuda from Hitotsubashi University. They will present on the compliance and risks associated with utilizing open source from an IP perspective. Additionally, they will explore initiatives within the open source community aimed at mitigating risks and maximizing the associated benefits.

This seminar is undoubtedly a diverse opportunity for those who are considering leveraging open source in the future or are interested in engaging in works related to open source.

Keith Bergelt

CEO, Open Invention Network

Keith Bergelt is CEO of Open Invention Network (OIN), the largest patent non-aggression community in history, created to support freedom of action in Linux as a key element of opensource software. Funded by Google, IBM/Red Hat, NEC, Philips, Sony, SUSE and Toyota, OIN has more than 3,800 community members and at its peak owned more than 1,200 global patents and applications. As CEO, Mr. Bergelt is directly responsible for enabling, influencing, and defending the integrity of the Linux ecosystem. Central to the achievement of his goals is the acquisition and transfer of patent rights designed to permit members of the Linux ecosystem to operate free of the threat of assertion and litigation from those whose business models are antithetical to innovation and global economic growth in information technology and computing.

Before joining OIN, Mr. Bergelt was president and CEO of two hedge funds – Paradox Capital and IPI – formed to unlock the considerable asset value of patents, trademarks and copyrights in middle-market companies. During Mr. Bergelt’s stewardship of these IP-based lending activities, he raised more than $300 million and financed portfolio companies of private equity firms including Texas Pacific Group, Kelso & Co, JH Whitney, Weston Presidio, Goode Partners, Palladium Capital and Castanea Partners, among others.


Masato Endo

Group Manager, Value Chain Service and Technology Development, Technical Project Field of Advanced R&D and Engineering Company, Toyota Motor Corporation

Masato Endo is a Group Manager of TOYOTA. He focuses also on building the Open Source governance structure within Toyota and developing relationships with the Open Source community, through projects such as AGL and OIN. From 2017, he began to work with the OpenChain Project as a board member and set up OpenChain JP WG with Hitachi and Sony. In 2019, he launched OpenChain Automotive WG to promote Open Source Software Supply Chain Management (OSS SCM) and standardization in Automotive industry. In 2023, he became a fellow of United States Japan Leadership Program. Originally, he was a patent engineer working with various technologies such as MaaS, Autonomous Vehicle, Navigation Systems, Intelligent Transport Systems, Smart Grid, and so on. His experience includes work in New Delhi to study Indian IP and External Affairs. In 2017, he worked for an IP project of the Japan Automotive Manufacturers Association and gave a technical lectures for examiners of each government of India, Thai, Mexico, Brazil and Argentina.


Shane Coughlan

General Manager, OpenChain, The Linux Foundation

Shane Coughlan is an expert in communication, security and business development. His professional accomplishments include building the largest open source governance community in the world through the OpenChain Project, spearheading the licensing team that elevated Open Invention Network into the largest patent non-aggression community in history and establishing the first global network for open source legal experts. He is a founder of both the first law journal and the first law book dedicated to open source. He currently leads the OpenChain Project and is a General Assembly Member of OpenForum Europe.


Yoshiro Matsuda

Ph.D. Student, Hitotsubashi University

Yoshiro Matsuda, also known as Yoshi, is a Ph.D. student at Hitotsubashi University, conducting research on the relationship between open source software and the patent system. His main role is as a Senior IP strategist at an internet company in the Silicon Valley, San Francisco Bay Area. Previously, Yoshi worked as a patent attorney at a private patent firm in Japan, handling hundreds of patent applications, prosecutions, trials, oppositions, and opinions in the field of computer technology. His career began as a software engineer, and now, drawing from his diverse experiences in technology and law, he explores the workings of the patent system and its benefits for clients.

Bay Area CHIZAI* (IP) is a unique networking platform (*CHIZAI means IP in Japanese). This group holds a seminar and networking event regularly in the Bay Area. Members are IP professionals, who are doing or interested in Japanese IP practices. Professor Toshiko Takenaka and NEDO Silicon Valley office founded this group. It is currently organized by Reina Sato, a JPO senior examiner and current senior director at NEDO Silicon Valley Office.

  • No-confidential discussions: Information brought to the presentation or discussion should not include any confidential matters or other materials that may require non-disclosure agreement or any other legal arrangement.

The conversations should be shard commonly across all participants, however any discussion topics or comments must not be publicized without a consensus.

We are a group of curious people who are interested in learning anything about technical, legal and business practices of IP that moves us. We hope that all participants will enjoy the band-new conversation platform as a safe place to network and learn from each other for years to come.
